A federal magistrate has rejected a request from former New Orleans Mayor Ray Nagin to order prosecutors to turn over a copy of a report on alleged prosecutorial misconduct before Nagin's trial on bribery charges begins.
U.S. Magistrate Alma Chasez ruled on Nagin's request following a hearing Monday. During the hearing she had expressed skepticism that the former mayor was entitled to the report, prepared in a separate case by federal prosecutor John Horn.
Nagin lawyer Robert Jenkins argued unsuccessfully that it wouldn't be fair to try his client without more information about Horn's probe of anonymous online comments posted by at least three federal prosecutors.
Nagin was the subject of anonymous posts by prosecutor Sal Perricone, who was a top deputy to former U.S. Attorney Jim Letten.
Nagin's trial is scheduled to begin Oct. 28.
